PCT History

The Patent cooperation Treaty is an agreement for international cooperation in the field of the patents, which provides a unified procedure for filing patent applications. Mainly, it is a treaty for cooperation and rationalization with regard to the PCT filing procedure, searching and examination of patent applications and the dissemination of the technical information contained therein.

Patent Cooperation Treaty History


The Patent Cooperation Treaty (PCT) is an international patent law treaty, which provides a unified procedure for filing patent applications to protect inventions in each of its contracting states. A patent application filed under the PCT is called PCT application or an international application. A single filing of an international application is made with a Receiving Office in one language. It results in a search performed by an International Searching Authority (ISA), accompanied by a written opinion regarding the patentability of the invention, which is the subject of the application. Optionally, it is followed by a preliminary examination, performed by an International Preliminary Examining Authority (IPEA). Finally, the relevant national or regional authorities administer matters related to the examination of application and issuance of patent. The PCT does not provide for the grant of an "international patent", as such multinational patent does not exist, and the grant of patent is a prerogative of each regional or national authority.
